The elements of criminal mischief are defined by C.R.S. 18-4-501(1) which lists the following elements:
1. That the defendant,
2. in the State of Colorado, at or about the date and place charged,
3. knowingly,
4. damaged the real or personal property of one or more other persons, including property owned by the defendant jointly with another person or property owned by the defendant in which, at the time of the damage, another person had a possessory or proprietary interest,
5. in the course of a single criminal episode.
Criminal mischief can be any offense level from either a class 3 misdemeanor to a class 2 felony depending upon the value of the personal property damaged. If the value is:
- Less than $300
- Up to 6 months in jail
- A fine of $50 to $750
- $300 to $750
- 3-12 months in jail
- A fine of $250,$1,000
- $750 to $1,000
- 6-18 months in jail
- A fine of $500-$5,000
- $1,000 to $5,000
- 12-18 months in prison
- A fine of $1,000 to $100,000
- $5,000-$20,000
- 1 to 3 years in prison
- A fine of $1,000 to $100,000
- $20,000-$100,000
- 2 to 6 years in prison
- A fine of $2,000 to $500,000
- $100,000-$1,000,000
- 4-12 years in prison
- A fine of $3,000 to $750,000
- More than $1,000,000
- 8 to 24 years in prison
- A fine of $5,000-$1,000,000
